Terms and Conditions

These Terms and Conditions (Terms) apply to (i) your access to and use of togetkey.com (the Site), and (ii) any purchase of digital products made through the Site. By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site or place an order.

- The Site is operated by OMNISCIENCE CARE SERVICES LTD (we, us, our), a company registered in England and Wales under company number 13719649, with its registered office at Dept 6378a 126 East Ferry Road, Canary Wharf, London, United Kingdom, E14 9FP.
- You can contact us at info@togetkey.com.
- We sell in our own name as principal (merchant of record). We are not a marketplace and we do not act as an agent for third-party sellers. Your contract for any purchase is with us.
- Our service provider identification information is provided in accordance with the Electronic Commerce (EC Directive) Regulations 2002 (SI 2002/2013).
- Interpretation and definitions
In these Terms:
- Business Customer means a person acting for purposes relating to their trade, business, craft or profession.
- Consumer means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
- Digital Content has the meaning given in the Consumer Rights Act 2015 and includes data supplied in digital form, such as game activation keys, access codes, and top-up codes.
- Key means an alphanumeric activation or access code supplied as Digital Content.
- Product means the Digital Content offered for sale on the Site.
- Order means your request to purchase a Product submitted through the checkout process.
- Contract means the contract between you and us for the supply of a Product under these Terms.
- Supply (or supply occurs) means, for the purposes of UK consumer law, the moment the Key is first made available to you (for example, displayed in your account/order page) and/or dispatched to you by email.
- Working Day means a day other than a Saturday, Sunday, or public holiday in England and Wales.
- 2.10.Headings are for convenience only and do not affect interpretation. References to laws are references to the laws of England and Wales unless stated otherwise.
- Eligibility and age requirement
- You must be legally capable of entering into a binding contract. The Site and Products are intended for users aged 18 or over (or the age of legal majority where you live, if higher).
- You are responsible for ensuring that accessing the Site and purchasing Digital Content is lawful in your country or region. Some Products may be restricted by region, publisher rules, age ratings, or local law.
- Accounts, security and communications
- You may need to create an account to purchase Products and access your order history. You must provide accurate, complete, and up-to-date information.
- You must keep your login credentials secure and confidential. You are responsible for activity on your account unless it results from our failure to take reasonable care.
- If you believe your account has been compromised, you must contact us promptly at info@togetkey.com.
- We may send you important service messages about your orders, delivery, or account (for example, order confirmations and support updates). These are not marketing messages.
- Products: description, functionality, and compatibility
- We supply Products in the form of Keys. Product pages typically indicate relevant information such as platform (for example Steam, PlayStation, Xbox), region restrictions, activation instructions, language options, and any prerequisites.
- You are responsible for checking, before purchase, that the Product is compatible with your device, operating system, account, platform region, and any technical requirements stated on the product page.
- Keys are redeemed and used on third-party platforms and are subject to the platform’s and publisher’s terms (including EULAs and terms of service). We do not grant you any intellectual property rights in the underlying game or software.
- If a Product is described as having region restrictions or other limitations, you must not attempt to circumvent those restrictions where doing so would breach applicable law or third-party platform/publisher terms.
- Prices, payment, taxes and errors
- Prices are shown in the currency displayed on the Site. Any applicable taxes (including VAT where relevant) will be shown during checkout and/or on your invoice/receipt.
- Payment is due at the time you place your Order using the payment methods made available at checkout. We do not offer a wallet or stored balance feature on the Site.
- Payments are processed using third-party payment providers. We may carry out reasonable fraud prevention checks (including requesting additional verification). If verification fails or fraud is suspected, we may refuse, cancel, or suspend an Order and, where payment has been taken, refund it.
- If there is an obvious pricing or listing error, we may cancel the affected Order. If we cancel after taking payment, we will refund the amount paid for that Order.
- Orders and contract formation
- Placing an Order is an offer by you to purchase the Product.
- Order confirmation does not guarantee availability until the Product is made available for access or download (for example, until the Key is made available in your account/order page and/or dispatched by email).
- We accept your offer and form the Contract when we make the Key available to you and/or dispatch it by email (as applicable).
- We may refuse or cancel Orders for legitimate reasons, including suspected fraud, breach of these Terms, technical errors, or where the Product is unavailable. If we cancel after payment, we will refund you.
- Delivery and supply of Digital Content
- Delivery is electronic. We deliver by making the Key available in your account/order page and/or sending it to the email address associated with your Order.
- Delivery is often near-instant, but delays may occur due to payment checks, system load, supplier processing, or outages affecting third-party services.
- You are responsible for ensuring your email address is correct and that you can receive emails (including checking spam/junk folders).
- Once a Key is delivered, you should store it securely and not share it. We are not responsible for loss or misuse resulting from you sharing the Key or failing to secure your account.
- Consumer cancellation rights and immediate supply of digital content
- If you are a Consumer, you may have a 14-day right to cancel certain distance contracts under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (SI 2013/3134) (CCR 2013).
- Digital Content exception: where Digital Content is not supplied on a tangible medium, the right to cancel is lost once supply begins during the cancellation period if (a) you have given express consent to supply beginning during that period, and (b) you have acknowledged that you will lose your right to cancel once supply begins.
- Because Keys are typically supplied immediately, we require you at checkout to give your express consent to immediate supply and to acknowledge that you lose your cancellation right once supply begins.
- This does not affect your statutory rights in relation to digital content that is faulty, not as described, or does not function as required under applicable consumer law. Nothing in this section affects any mandatory consumer rights you may have under applicable law.
- If you do not consent to immediate supply, we may be unable to complete your Order or we may delay making the Key available until after the cancellation period ends, depending on the Product and technical constraints.
- Where a cancellation right remains available (for example, if supply has not begun), you may cancel by sending us a clear statement at info@togetkey.com. You may use the model cancellation form in Appendix A, but it is not required.
- Statutory rights for Digital Content (Consumer Rights Act 2015)
- 10.1.Nothing in these Terms limits or excludes your statutory rights. If you are a Consumer, the Consumer Rights Act 2015 requires Digital Content we supply to be as described, of satisfactory quality, and fit for purpose (taking into account all relevant circumstances).
- 10.2.If the Digital Content does not conform, you may be entitled to remedies under the Consumer Rights Act 2015. Depending on the circumstances, these remedies may include repair or replacement, and if that is not possible or is not provided within a reasonable time and without significant inconvenience, a price reduction or refund (as applicable).
- 10.3.Where the issue relates to a Key being invalid, duplicate, or already redeemed, we may need to investigate with our suppliers and/or relevant platforms. You agree to provide reasonable information and evidence to help us investigate (for example, screenshots showing the error message and the time/date).
- Invalid, duplicate, or already-redeemed Keys: support process
- If a Key does not work as described, you must contact us promptly at info@togetkey.com and include your Order ID and relevant details.
- We may request information reasonably necessary to assess the issue, including (where relevant) screenshots of error messages and confirmation that the Key has not been shared.
- If we confirm the Key is defective or not as described, we will provide an appropriate remedy in line with your statutory rights and these Terms. This will typically be a replacement Key where available. Where a replacement is not possible or appropriate, we will consider a price reduction or refund as required by applicable law.
- Business Customers
- 12.1.If you purchase as a Business Customer, the Consumer cancellation rights described in section 9 do not apply.
- 12.2.For Business Customers, to the fullest extent permitted by law, we exclude implied terms and conditions that would otherwise apply. This does not affect liability that cannot lawfully be excluded.
- Chargebacks and payment disputes
- 13.1.Refunds are governed by the Refund and Returns Policy. In case of conflict Refund and Returns Policy shall prevail.
- 13.2.If you believe there is an issue with an Order, you should contact us first at info@togetkey.com so we can try to resolve it.
- 13.3.If you initiate a chargeback or payment dispute, we may provide evidence to the payment provider (including confirmation of delivery/supply). Where a dispute is raised after a Key has been supplied, we may suspend access to your account pending resolution and take reasonable steps to prevent fraud and abuse.
- Acceptable use and prohibited conduct
- 14.1.You must not use the Site in a way that is unlawful, fraudulent, or harmful, including by:
- 14.1.1.attempting to obtain Keys without paying, or engaging in chargeback abuse;
- 14.1.2.interfering with the Site’s security or operation, introducing malware, or attempting to bypass safeguards;
- 14.1.3.using automated tools (bots, scrapers) that disrupt the Site or access it in an unauthorised way;
- 14.1.4.attempting to circumvent region restrictions where doing so breaches third-party terms or applicable law.
- 14.2.We may suspend or restrict accounts or access to the Site where we reasonably suspect fraud, security issues, or a material breach of these Terms, subject to applicable law.
- Intellectual property
- 15.1.The Site (including its design, text, graphics, logos, and software) is owned by us or licensed to us and is protected by intellectual property laws.
- 15.2.Game titles, publisher names, and trademarks belong to their respective owners and are used for identification only.
- Third-party platforms, services and links
- 16.1.Redemption and use of a Key depends on third-party platforms and publishers and their service availability and policies. We do not control those systems.
- 16.2.The Site may include links to third-party services or content. We are not responsible for third-party content, terms, or privacy practices. Your use of third-party services is at your own risk and subject to their terms.
- Liability
- 17.1.We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
- 17.2.Subject to section 17.1 and your statutory rights (including under the Consumer Rights Act 2015), our total liability to you arising out of or in connection with a particular Order will not exceed the amount you paid for that Order.
- 17.3.We are not liable for losses that are not reasonably foreseeable at the time the Contract is formed.
- 17.4.We are not responsible for failures or delays caused by matters outside our reasonable control, including outages or disruptions affecting third-party platforms, payment providers, or communications networks, provided we take reasonable steps to mitigate the impact.
- Changes to the Site and these Terms
- 18.1.We may update the Site, its features, and these Terms from time to time, for example to reflect changes in law, security needs, or our business operations.
- 18.2.The Terms that apply to your Order will be the version presented to you at checkout at the time you place the Order.
- Complaints and how to contact us
- 19.1.If you have a complaint, please contact us at info@togetkey.com with your Order ID and a clear description of the issue. We will investigate and respond within a reasonable time.
- Governing law and jurisdiction
- 20.1.These Terms and any Contract are governed by the law of England and Wales.
- 20.2.If you are a Consumer, you may also benefit from mandatory protections under the laws of the part of the UK where you live.
- 20.3.The courts of England and Wales will have jurisdiction over disputes, subject to any mandatory rights you may have as a Consumer.
